Publishing Deal

The contract between songwriter and publisher covering copyright share and royalties

A publishing deal is a contract in which a songwriter assigns all or part of a work's publishing rights to a publisher, or engages one to exploit them. It sets the copyright share, advance, royalty rate and term, and whether the publisher handles promotion, registration and enforcement.

It is often confused with co-publishing or an administration deal: the first divides copyright, the second only manages it without taking a share. The usual mistake is to assume a publishing deal guarantees promotion: put promotion duties in writing, or the deal may amount to collection and registration only. This is general information, not legal advice.
